As of yesterday, USCIS announced that it had returned all of the unselected cap-subject H-1B petitions submitted for FY2016. This means that of the roughly 233,000 petitions that were filed, after the 20,000 advanced degree cap petitions and 65,000 general category petitions were selected, the remaining 148,000 unselected petitions should have now been returned to the petitioners or their counsel. Petitioners that have not received their unselected petition or other notice are advised to contact USCIS.
If you did not consider this year’s H-1B “season” over before, it is officially over now. Of course, H-1B petitioners who are not subject to the cap can continue filing.
