We provide representation with the U.S. Department of Labor (DOL) with respect to the Alien Labor Certification (PERM) process including drafting job language, providing analysis for possible prevailing wage determination, applying with DOL for the position’s prevailing wage, preparing recruitment documentation, advising and assisting with recruitment steps, reviewing employer interviews and analysis of candidate applications, working with employee in preparing Part K of PERM to verify the employee meets all of the skill requirements, final preparation of PERM online application, and filing of PERM with U.S. Department of Labor. We have substantial experience in Job A/Job B situations which allow the alien to use skills and experience obtained on the job to qualify for the PERM position. We are experienced in the use of employer provided surveys for the purpose of obtaining prevailing wages.
We also provide representation with respect to cases not needing PERM filings such as form I-140 for Aliens of Extraordinary Ability, Outstanding Professors and Researchers, National Interest Waivers, and Schedule A I-140 filings. We prepare and file I-140 Immigrant Visa Petitions following approval of a PERM case. We prepare the analysis of the “ability to pay” and the alien’s documentation of meeting the PERM job requirements. We will file to recapture any applicable earlier priority date. After the I-140 is approved and when the alien employee’s visa number becomes available, we will assist in the filing of form I-485 to obtain an Adjustment of Status from the employee’s Non-immigrant status to that of a U.S. Permanent Resident.
